Compliance Status

The NPDB uses information from the State licensing and certification agency (State licensing board) to help determine compliance. There are eight compliance determinations. Four are based on adverse action comparison reviews and four are based on attestation. Adverse action comparison review determinations only apply to State licensing boards that participated in a comparison review and only include professions selected for the review.

Compliance statuses for all other boards and professions are based on the board's attestation results.

Adverse Action Comparison Review

Compliant

The State licensing board:

  1. Submitted all reportable actions to the NPDB for the specified period of the review; or
  2. Provided an appropriate justification for any identified missing action that does not meet NPDB reporting requirements; or
  3. Certified that there are no reportable adverse actions for the specified period and assured the NPDB that the board will comply with reporting requirements in the future.

Non-compliant

The State licensing board:

  1. Has not responded to HRSA's written request to reconcile or report actions identified as missing; or
  2. Has not responded to HRSA's request for data; or
  3. Refused to register with the NPDB and submit reportable actions taken by the board to the NPDB.

Working Toward Compliance

In response to HRSA's written request for action, the State licensing board agreed on a timeline to submit all required reports for the profession. The board has started submitting reports and their progress towards full compliance is acceptable.

Under Review

The deadline for the State licensing board to respond to HRSA's written request for action or data has not passed or there are extenuating circumstances that prevent HRSA from making a compliance status determination.

Attestation

Attested

The State licensing board certified that it submitted all required actions to the NPDB for the profession during the specified time frame, and they will continue to report required actions within 30 days of the date the action is taken.

Could Not Attest

The State licensing board cannot certify that they submitted all required actions to the NPDB for the profession during the specified time frame.

Failed to Attest

The State licensing board did not complete their attestation by the due date. The attestation is due no later than 30 days after the board's NPDB registration renewal is due.

Not Reviewed

HRSA has not completed its review of a particular profession before the end date of the previous review period.

Note: Not all states license or certify the same professions. It is difficult to make a direct comparison between states.
